
Terms and Conditions
By accessing our website or enrolling in a course with Freedive Life Ltd, you agree to be bound by the following terms and conditions.
1. Course Enrolment and Eligibility
You must be at least 18 years old to enrol, or 16 with signed parental/guardian consent.
By enrolling, you confirm that you meet all course pre-requisites, including appropriate physical fitness and swimming ability.
You must review and complete the medical questionnaire and liability release form before booking. If you answer “yes” to any questions on the medical form, you must obtain written clearance from a doctor experienced in diving medicine before booking.
Freedive Life Ltd cannot provide medical advice and reserves the right to deny participation if documentation is incomplete or non-compliant at the time of the course. Refunds will not be issued in these cases.
2. Course Content and Access
Our courses are designed to provide educational and practical freediving instruction.
Course materials (videos, documents, text, and images) are for your personal use only and may not be copied, shared, or redistributed without prior written permission. Upon full payment, access to course materials will be granted for a defined period. This access is non-transferable and intended solely for the enrolled individual.
3. Intellectual Property
All course content is the intellectual property of Freedive Life Ltd and AIDA International. Unauthorised use, copying, or distribution is strictly prohibited.
4. Refunds and Cancellations
4.1 Statutory Cooling-Off Period
If your course starts within 14 days of booking, you acknowledge and agree to waive your statutory cancellation rights under the Consumer Contracts Regulations 2013. No refund will be issued in such cases.
If your course starts more than 14 days after booking, you may request a refund within 14 days of enrolment, minus a 2% non-refundable card processing fee, provided no course materials have been distributed to your registered email.
4.2 Course Non-Attendance or Changes
If you are unable to attend a booked course, you must provide 30 days’ notice to transfer to the next available course date.
– With less than 30 days’ notice, we will attempt to fill your place. If successful, you may transfer your booking. If not, your place will be forfeited, and no refund will be given.
– We are unable to offer refunds or course transfers if less than 30 days’ notice is given, including where cancellation is due to illness, travel disruption, or other personal circumstances.
– Similarly, no partial refunds or transfers will be provided if you are only able to attend part of the course for any reason, including arriving late, leaving early, or becoming unwell during the course.
We strongly recommend that you take out suitable insurance to cover these eventualities, including non-attendance, early departure, or cancellation due to health or travel-related issues.
4.3 Course Cancellation by Us
In the unlikely event that we cancel or reschedule a course, you will be offered either:
– A full refund of the course fee, or
– A transfer to an alternative course date at no additional cost.
Freedive Life Ltd is not liable for any additional costs you may incur, including but not limited to travel, transport, accommodation, or loss of earnings. We recommend making flexible travel plans and obtaining appropriate insurance.
5. Participant Responsibility
Students must follow all safety instructions issued by instructors.
Freedive Life Ltd reserves the right to remove any participant from a course without refund if their behaviour compromises safety, disrupts others, or breaches our terms.
6. Course Completion and Certification
Certification is issued upon successful completion of course requirements, including theory and practical assessments.
If requirements are not fully met, the instructor will issue a summary of outstanding skills on request. You may arrange additional sessions (additional fees apply) or complete them with another certified instructor using the provided referral form.
7. Limitation of Liability
While all reasonable steps are taken to ensure your safety, participation in freediving activities carries inherent risks. Freedive Life Ltd accepts no liability for personal injury, loss, or damage unless caused by proven negligence. It is your responsibility to ensure you are medically fit and have adequate insurance coverage.
8. Privacy and Data Protection
Your personal data is processed in accordance with UK GDPR. By enrolling, you consent to the collection and use of your data necessary for delivering and certifying your course.
9. Termination of Access
Freedive Life Ltd reserves the right to remove access to course content or in-person sessions if terms are breached or if your conduct poses a risk to instructors or other students.
10. Amendments
These Terms & Conditions may be updated periodically. Updates will be published on our website and come into effect from the date of publication.
11. Equipment Hire Policy
11.1. Booking and Availability
Equipment hire should be requested at the time of booking your course. Sizing is based on manufacturer guidelines. Freedive Life Ltd is not responsible for fit issues but will attempt to provide alternatives where available.
11.2. Payment
Gear hire fees must be paid in full before equipment is reserved for your use.
11.3. Condition and Responsibility
All hired equipment must be returned in the same condition as it was issued. Equipment is thoroughly checked prior to hire. You are responsible for inspecting the equipment on receipt and for notifying the instructor of any pre-existing damage before use.
You are fully responsible for all hired equipment from the time it is issued until it is returned and checked by a Freedive Life Ltd representative.
If equipment is lost or damaged beyond normal wear and tear, you may be held liable for the cost of repair or replacement.
We are reasonable in our approach:
– If damage is accidental and minor, and can be easily repaired, we will not charge.
– If damage is accidental but cannot be repaired, or is the result of negligence, misuse, or failure to follow instructions, we reserve the right to charge the full retail replacement cost.
– In cases of malicious damage, the full replacement cost will apply.
Course certification will be withheld until any repair or replacement costs are settled.
11.4. Late Returns and Unused Kit
Late returns will incur daily charges of £10 until returned. Any course certification will be witheld until equiptment is returned and outstanding charges settled.
No refund will be issued for unused equipment once booked.
By booking a course or hiring equipment from Freedive Life Ltd, you confirm that you have read, understood, and agree to these Terms & Conditions.
12. Governing Law and Jurisdiction
These Terms & Conditions, and any dispute or claim arising from them or in connection with your use of our services, shall be governed by the laws of England and Wales. You agree that any dispute or legal proceedings will be dealt with by the civil courts of England and Wales, and that such proceedings must be brought in the county court or High Court located nearest to Freedive Life Ltd’s principal place of business in Dorset, unless otherwise required by consumer protection law.
